Judge Is Considering Mistrial In The Derrick Rose Case

On Tuesday Michael W. Fitzgerald the federal judge in the Derrick Rose rape case, stated that he is considering to motion a mistrial.  According to Rose’s attorney, the plaintiff’s attorney and her legal team withheld text messages that could have helped Derrick Rose in his case.  The plaintiff allegedly withheld these text messages on purpose, because it could have proved that the sex was consensual.

Rose’s attorney Mark Baute, criticized the plaintiff’s attorney Waukeen McCoy, claiming that he ignored his request for the text messages, so that Baute could not present them during the trial.  McCoy denied the allegations claiming he thought that the text messages were handed over.

Fitzgerald stated that if the plaintiff and her team can not come up with these key text messages, then he will in fact consider a mistrial.  There is no update on the time limit for these text messages to be handed over.
